This is an appeal from a judgment of conviction following a rehearing. The accused was originally found guilty, by a general court-martial convened in Korea, of cowardly conduct in the presence of the enemy- — -in that he wrongfully refused to report to his battle station, in violation of Article 99, Uniform Code of Military Justice, 50 USC § 693. He was sentenced to receive a dishonorable discharge, as well as to total forfeitures and confinement at hard labor for fifteen years.
