The defendants appeal from a judgment in favor of the plaintiff in an action to quiet title.
The defendant, Lightston, is treasurer of the city of San Jose. The defendant, City Improvement Company, is the holder of bonds issued for the amount of an assessment against the property of the plaintiffs for certain improvements to the street fronting thereon. The City Improvement Company performed the work of improvement for which the assessment was made and it holds the bonds issued against the plaintiffs’ lots.
