HENDERSON, Judge.
Appellant was convicted of swindling, and his punishment assessed at confinement in the penitentiary for a term of five years; hence this appeal.
The indictment is quite lengthy, and is in several counts. As the disposition of the case turns on the indictment we state the substantial elements thereof. The swindle is alleged to have been perpetrated by appellant on -the Fidelity Mutual Life Association of Philadelphia, subsequently changed to the Fidelity Mutual Life Insurance Company of Philadelphia, the same being a corporation.
