The defendant, Roy H. Miller, was convicted of the crime of obtaining money by false pretenses, and appeals from the judgment which followed, assigning as error, inter alia, the action of the court in refusing to instruct the jury, as requested, to return a verdict of not guilty.
It is argued by Ijis counsel that the testimony shows that there was no intent on the part of the defendant to defraud the person from whom the money and property were obtained, and that such person never relied upon any alleged false pretense as a means inducing him to part with any of his property and hence an error…
