This is an appeal from an order of the district court of Martin county denying defendants’ alternative motion for amended findings or a new trial.

The action is to obtain specific performance of an oral contract which plaintiff asserts he made with the decedent, John Soboll. Under the terms of the contract plaintiff claims that the decedent agreed for a valuable consideration that at his death he would leave and give to the plaintiff all of his property.
