This case comes before the court on the motion of National Union Fire Insurance Company of Pittsburgh, Pa. (hereinafter referred to as “NU”) to refer the Trustee’s objection to proof of claim to arbitration, pursuant to 9 U.S.C. §§ 1-14. This matter arises from the objection of the Trustee, J. Baxter Schilling, to National Union’s proof of claim. After engaging in discovery and clarifying the Trustee’s claims, NU filed the arbitration motion, both parties fully briefed the issue, and the court conducted oral arguments on January 29, 2001.
