LAY, Chief Judge.
Jessie Lee Wise filed this petition for a writ of habeas corpus under 28 U.S.C. § 2254 (1988), challenging the voluntariness of his 1972 guilty plea to first degree murder. The district court 1 adopted the magistrate’s 2 findings of fact and conclusions of law dated October 12, 1990, and denied Wise’s petition pursuant to Rule 9(a) of the Rules Governing Section 2254 Cases in the United States District Courts. 3 The court further found Wise’s allegations to be without merit.
