Plaintiffs John and Marguerite Viteritti (“plaintiffs” or “the Viterittis”) commenced *586this action alleging that defendant Incorporated Village of Bayville (“defendant” or the “Village”) seized a portion of their real property without providing them with just compensation in violation of their Fifth Amendment rights.
