We consider first whether plaintiff’s action should have been nonsuited.
Plaintiff’s evidence, in accord with his allegations, tends to show plaintiff’s Volkswagen, with headlights dim, was moving slowly in a southerly direction, entirely on the east shoulder, one wheel on the paved portion of the shoulder and the other on the sod portion thereof, when defendant, who had been driving his truck in the lane for northbound traffic, turned to his right onto the east shoulder and there collided with plaintiff’s Volkswagen; and that, when defendant turned from his traffic lane onto the east…
