This is a suit in equity brought under the provisions of section 2326 of the Revised Statutes to determine the rights of the respective parties to certain mining .ground situated in Yreka mining district, Bhoshone county, Idaho. On August 21, 3895, appellant applied for a patent to the Shoshone lode claim. Appellees thereafter filed their protest'and an adverse claim against said application, and in due time commenced this suit in support of their claim in the circuit court of the United States for the district of Idaho.
