DECISION AND ORDER

MARRERO, District Judge.

Petitioner Leon Cummings (“Cummings”), seeks a writ of habeas corpus pursuant to 28 U.S.C. § 2254. Magistrate Judge Frank Maas issued a Report and Recommendation, dated November 12, 2002 (the “Report”), recommending that the petition be denied in all respects. 1 The Report is incorporated hereto as Attachment A. Cummings has interposed no objection to the Report. The deadline given by Magistrate Judge Maas for submission of covenants having passed, the Court now rules on the matter.
