Error to Wayne; Rohnert, J. Assumpsit by the Fifth Avenue Library Society against William Gh Hastie for goods sold and delivered. There was judgment for plaintiff on a verdict directed by the court, and defendant brings error.

This case was originally commenced in justice’s court. Plaintiff declared on all the common counts *57and on a written contract. Defendant filed a plea of the general issue. The case was tried in justice’s court, and a judgment rendered in favor of the plaintiff, from which judgment defendant took an appeal to the circuit court. The case was tried by a jury. A verdict was directed for the plaintiff for $41.25, the amount of the claim. The case is brought here by writ of error.
