Appeal from a judgment of the superior court for Mason county, Mitchell, J., entered October 30, 1916, in favor of the plaintiff upon the pleadings, in an action to recover a tax paid.

This action was brought to recover- a tax, alleged to be void, paid under protest. The appellant filed a *206demurrer to the complaint upon the grounds: First, that the court had no jurisdiction of the subject-matter; second, that the plaintiff had no legal capacity to sue; third, that there was a defect of parties defendant; fourth, that the complaint does not state a cause of action; fifth, the 'action was not commenced within the time limited by law.
