The issues before us arise in a lawsuit for personal injuries brought by James T. Jor-gensen against three separate defendants who are no longer parties to this action. Because Jorgensen was receiving workers’ compensation benefits from the Colorado Compensation Insurance Authority (CCIA) as a result of these injuries, CCIA intervened during the course of the litigation to protect its subrogation rights.
