VOLLACK, Justice.
Petitioners, the Humphreys, sought cer-tiorari from the court of appeals’ opinion in Southwestern Development Co. v. Humphrey, 709 P.2d 51 (Colo.App.1985), which held that neither the district court nor the court of appeals had jurisdiction over this water rights title dispute. Southwestern Development Company [hereinafter SWDC] brought suit in district court in a dispute over the ownership of certain water rights and a related lease.
