Plaintiff, the grantee in a statutory warranty deed, brought suit against the defendants, his grantors, to recover from the latter the amount of taxes which had become due and, in part, delinquent on certain lands at the time of the execution and delivery of the deed therefor to the plaintiff and which, with accrued interest, were thereafter, shortly prior to the commencement of this action, paid by him. The cause was tried to the court without a jury and resulted in a judgment in favor of the plaintiff. The defendants appealed.
