This is a motion by the defendants for summary judgment dismissing the complaint upon the ground that the action is claimed not to have been timely commenced. The plaintiffs, wife and husband, sue to recover damages for personal injuries allegedly sustained by the wife while a passenger aboard the S. S. Vulcania of the Italian Line from Naples to New York. The ticket of passage (which was purchased hy the wife in Italy) provided for a one-year period of limitation for the institution of an action.
