The plaintiff sues to recover the sum of $30,731.68, for commissions allegedly due the plaintiff’s *25assignor, Julio Eoea Vianna, in connection with the delivery of an aggregate of 8,000 automobile and truck tires and 1,646 tubes by the defendant to Danilo Nunez in Porto Alegre, Brazil. The cause came on for trial before the court without a jury. Findings of fact and conclusions of law were duly waived by the parties (Civ. Prac. Act, § 440).
