The plaintiff, Mrs. Vigelius, seeks recovery from the defendant, Mr. Vigelius, her former husband, of the sum .of $10,000, claimed as the balance owing by him to her under a separation contract entered into between them. A trial upon the merits in the superior ■ court for King county, sitting without a jury, resulted in findings and judgment denying to her any Tecovery, from which she has appealed to this court.
