Plaintiff brought this action to recover upon a life insurance policy. Defendant demurred to the complaint, but subsequently tendered and paid into the registry of the court, as and in full settlement of all liability under the policy, an amount less than that sued for in the complaint. Plaintiff refused to accept the tender, but insisted upon recovery of the full amount prayed for, and, accordingly, elected to stand upon her complaint.
