—This appeal is' from a judgment in the plaintiffs’ favor in an action brought by them to obtain an injunction preventing the defendants from an alleged actual and proposed diversion of the waters of the upper San Joaquin River and its tributaries to the irreparable injury of the plaintiffs through the interference thereby with riparian rights of the latter in and to the flow and use of the waters of said river upon, along, and across their lower lying lands contiguous to the banks and course of said river.
