This is an appeal from a judgment permanently enjoining the defendant, City of Vallejo, as an appropriator, from storing any of the waters of Gordon Valley Creek. The operation of the injunction was stayed upon certain conditions pending a determination of the appeal.

Gordon Valley Creek and Wooden Valley Creek have their sources in separate watersheds in Napa County and flow southerly to their junction in the southern portion of said county.
