OPINION AND ORDER
SOTOMAYOR, District Judge.
Plaintiff Manuel Batista brings this action, pursuant to 42 U.S.C. §§ 405(g) and 1383(c)(3), to challenge a final determination of the Commissioner of Social Security (“the Commissioner”), denying plaintiffs application for disability insurance benefits and Supplemental Security Income (“SSI”) based on disability. Pursuant to Fed.R.Civ.P. 12(c), both parties have moved for judgment on the pleadings. For the reasons to be discussed, both motions for judgment on the pleadings are DENIED.
