MEMORANDUM OPINION

MOTLEY, District Judge.

Plaintiff, a former employee of defendant Merrill Lynch, Pierce, Fenner & Smith, Inc. (“Merrill Lynch”), alleges that defendants have violated the Americans with Disabilities Act (“ADA”), 42 U.S.C. §§ 12101 et seq., and the New York Executive Law § 296. Plaintiff also claims that the defendants have committed the tort of intentional infliction of emotional distress.
