Attorney Lee Nuwesra (“appellant”) appeals from an order of the United States District Court for the Southern District of New York (Motley, J.) sanctioning him under Fed.R.Civ.P. 11(c)(1)(B). Appellant represented plaintiff Ernesto Forbes (“plaintiff’) in his unsuccessful lawsuit alleging that defendants Merrill Lynch, Fen-ner & Smith, Inc. (“Merrill Lynch”), Yolanda D’Apuzzo (“D’Apuzzo”) and Anthony DiBiase (“DiBiase”) (collectively, “defendants”) fired him on account of his HIV status in violation of federal and state law.
