This is an action to recover upon an account-stated, where the answer is a general denial, a special denial by way of explanation claiming the amount sued for as-set apart by him for his own compensation under agreement for services rendered, and a cross petition for balance due him for services rendered alleging such compensation due him by virtue of an agreement and also on quantum meruit basis.
