Elmer and Lucille Koch filed identical claims in the estates of Elmer’s parents, Arthur L. Koch and Clara E. Koch, which were consolidated for trial. In Counx I they sought to recover $24,620.22 on a “verified acknowledgment of debt”. Count II was an alternative count in the same amount based upon individual transactions for moneys loaned and advanced, services rendered and work performed. In Count III Lucille Koch claimed $9000 for housekeeping and nursing care for Clara E. Koch. The administrator filed a counterclaim for $22,989.80.
