The action is brought to recover from W. R. Arthur & Company, Inc., and its insurer, for injuries sustained by the plaintiff in a collision of his automobile which he was driving with a truck driven by a servant of the defendant, W. R. Arthur & Company, Inc.
Two propositions are involved: (1) The plaintiff-respondent moves to dismiss the appeal for want of proper service of notice of appeal upon respondent’s counsel.
