This is an appeal from an order of the district court denying plaintiff’s motion for a new trial and from the judgment entered pursuant to the court’s order.

The action is brought for an accounting seeking to establish that certain property acquired jointly by two brothers, Chris and Michael M. Balafas, over a lifetime of working and dealing together constituted partnership property and that one-half thereof, upon the death of Michael M. Balafas, belonged to his estate.
