Plaintiff, City Insurance Company (“City Insurance”), seeks an order to modify the automatic stay provided in section 362(a) of the Bankruptcy Reform Act of 1978 (“Code”), in order to pursue its pending suit against Mego International, Inc., (“Mego”) the insured debtor, and certain of its insured officers and directors. In that suit, City Insurance seeks to rescind or determine coverage under an insurance contract.
