DECISION ON MOTION TO DISMISS COMPLAINT OF TRUSTEE

The trustee in bankruptcy commenced an adversary proceeding to recover as a preferential transfer voidable under 11 U.S.C. § 547 of the Bankruptcy Code the proceeds from a Blue Cross/Blue Shield Medical insurance policy in the sum of $4350.00 that were paid by Blue Cross/Blue Shield directly to The Society of The New York Hospital (“New York Hospital”) on behalf of the debtors in this case within three months prior to the filing of their joint petition under Code § 302 on March 28, 1981.
