ORDER
NORGLE, District Judge.
Before the court are the objections of plaintiff Equal Employment Opportunity Commission (“EEOC”) and defendant Harris Chernin (“Chernin”) to Magistrate Judge Edward A. Bobrick’s report and recommendation that this court grant in part and deny in part Chernin’s summary judgment motion against EEOC. For the rea sons discussed below, Chernin’s objections are sustained and the EEOC’s objections are overruled.
