The appellant, William Bay Toombs, was the duly elected prosecuting attorney of Washing-ton county, Miss., and filed his petition for writ of mandamus in the circuit court of said county against Pat Sharkey et al., composing the board of supervisors of said county; that he had occupied said position for some years prior to January 1, 1924.
