In a court of a justice of the peace, prosecution, by affidavit, was instituted against the appellant, S. C. Clark, charging him with unlawfully practicing the profession of barbering without a valid certificate of regis: tration as a registered barber, which resulted in his being tried, convicted, and sentenced to pay a fine of twenty-five dollars and costs. He appealed to the county court, and there the case was tried on an agreed statement of facts.
