Appellant, Don S. McAuliffe, appeals from the Franklin County Court of Common Pleas, where the trial court granted summary judgment to appellee, Board of Public Employees Retirement System of Ohio, in this action for mandamus and declaratory relief. The court thus rejected appellant’s claim that he was entitled to Public Employee Retirement System (“PERS”) state pension benefits for the years he worked as a village solicitor or law director for the communities of Pickerington and Baltimore.
