— This suit was brought by the appellee against the city of San Antonio, a municipal corporation, its mayor, Bryan Callaghan, and its treasurer, Charles Hummel, to recover against the city the sum of $8,664.11, alleged to be due upon warrants, owned and held by appellee, issued by the city for the salaries of its officers and emploj'es for various sums due them, which were a part of its current expenses for the month of May, of the fiscal year commencing June 1, 1903, and ending May 31, 1904; and to enjoin the city and its codefendants from diverting the revenue…
