The plaintiff appeals from a judgment of the Clay County Circuit Court dismissing his bill for an injunction after a demurrer thereto had been sustained and he had declined to plead further. Owing to the public importance of -the questions involved and the necessity for an early decision thereof,-the appeal has been advanced -on our docket and the parties have waived oral argument and submitted the cause on briefs.
