By his third amended complaint filed herein plaintiff alleged that he is a retired U. S. Navy Lieutenant, a graduate of the U. S. Naval Academy at Annapolis, Maryland, and was known to defendant bank as Lieutenant W. C. Allen; that he was engaged in the engineering business and that between August 21st and September 21st, 1940, he had on deposit in a commercial bank account with defendant bank at Los Angeles, California, a sum of money in excess of $25.
