OPINION

SHEA, Justice.

This matter is before the Supreme Court on the plaintiffs, Patricia M. Lyons, appeal from a judgment for the defendants entered in the Superior Court after granting the defendants' motion for summary judgment. We affirm.

The plaintiffs, Patricia M. Lyons and Jeffrey H. Ogert, filed suit on February 26, 1986. They alleged that, under 42 U.S.C. § 1983, their civil rights were violated when they sustained personal injuries as a result of an assault and battery by defendant, Michael Calenda, a subordinate officer and patrolman of the town of Scituate police department.
