Like a battlefield surgeon sorting the hopeful from the hopeless, a motion to dismiss invokes a form of legal triage, a paring of viable claims from those doomed by law. This matter is before the Court on defendants’ partial motion to dismiss pursuant to Féd.R.Civ.P. 12(b)(6) or, in the alternative, to compel a more specific statement of plaintiffs claims pursuant to Féd.R.Civ.P. 12(e).
