This petition for a declaratory judgment was brought pursuant to the provisions of G. L. 1956, chap. 30 of title 9. The petitioner therein asked, first, whether an action for malicious use of process is an action for injury to the person within the meaning of G. L. 1956, §9-1-14, and is barred by the provisions of said statute if not brought within two years after the cause of action has accrued and, second, whether a cause of action for malicious use of process 'brought againsit it in the federal district court is barred by the provisions of said statute.
