This is a suit in equity to enjoin the defendant from interfering with the flow of surface water upon his land frqm the adjoining land of the plaintiff. It appears conclusively from the record in this case that there is a low place or sag in the land that holds water after a heavy rain or melting snow at a point on the division line between the farms *381of the parties to this litigation; that the defendant has threshed his grain, piling the straw therefrom in the depression on his side of the division line, and in addition thereto has put in some planks and piled the straw behind them; that the…
