In this action the court below sustained a demurrer, lor want of sufficient facts, to the complaint, which, in substance, is as follows: In the latter part of the year 1906 appellant desired to open a lace and embroidery store in the city of Indianapolis, provided a desirable location could be found in the business section of such city. About this time negotiations were had between appellant and appellee, as the result of which they agreed to engage together in the lace and embroidery business, each to invest $3,500, and each to own a half interest in the business to be established.
