This action was brought by George M. Wright, as guardian of William Moody, an insane person, for the purpose of establishing and enforcing an alleged trust, in certain real estate, against Martha Moody and Fanny Walton, who were alleged to be in possession under a deed, claiming to be the owners in fee simple.

It is averred in the complaint that James F. Eule died intestate in the year 1857, the owner of certain real estate in Shelby county, Indiana, and that his widow, Hester A. Eule, and several children survived him as heirs at law, and that all of his children except Mary B., who…
