OPINION

MARGOLIS, Judge.

This maritime subsidy case is before the court on plaintiff’s motion for summary judgment and defendant’s cross-motion for summary judgment. The plaintiff, American Maritime Transport, Inc. (AMT) brought this action to recover payment of Operating Differential Subsidy (ODS) by the United States Maritime Administration (MARAD) and Maritime Subsidy Board (MSB or Board) under an Operating Differential Subsidy Agreement (ODSA).
