OPINION

MARGOLIS, Judge.

This congressional reference case is before the Court on plaintiffs motion for partial summary judgment and defendant’s cross-motion for summary judgment. Plaintiff requests that this Court grant summary judgment solely on the issue of liability. In plaintiffs brief, however, plaintiff does not argue why the government is liable to the plaintiff, other than to assert that the government is bound by the factual determinations in a prior congressional reference proceeding.
