Preliminary Statement

Plaintiff, Rubie’s Costume Company (“Rubie’s”), sued to challenge the United States Customs Service’s (“Customs”) denial of its domestic interested party petition concerning the classification of certain imported textile costumes as “festive articles” within Chapter 95 of the Harmonized Tariff Schedule of the United States (“HTSUS”). Plaintiff now moves for summary judgment, claiming that these costumes should have been classified as “wearing apparel” within subheading 6114.30.30 of the HTSUS.
