McCLURE, District Judge.
BACKGROUND
Federal Kemper Insurance Company (“Federal Kemper”) filed this declaratory judgment action 1 against Frederick Hanes, individually and t/a Blue Spruce Farms, and Daniel Jones to ascertain its obligations under a comprehensive general liability policy issued to Hanes. 2 Jones was injured in a November 25, 1985 farm accident when a modified tractor-trailer dump truck tipped and fell on him during an unloading operation.
