1Opinion of the Court

Robinson, C. J. —

The appellant sued the appellee on a promissory note for one hundred and thirty-seven dollars, dated April 4th, 1876, due in one day after date, with ten per cent, interest and attorney’s fees.

*259The cause was tried by the court. The finding and judgment was for the appellee.

The appellant presses for our consideration the alleged error of the circuit court in overruling the demurrer to the second paragraph of the appellee’s answer, which, omitting the caption and signature of attorneys, was as follows, to wit:

“ For a second and further answer to plaintiff’s complaint defendant…
