Introduction
The present action is before the court on the United States’ (government or defendant) motion for summary judgment based upon the affirmative defense of accord and satisfaction, and plaintiff’s cross-motion. Plaintiff, King Fisher Marine Service, Inc. (King Fisher) filed a complaint in this court on September 30,1985, alleging entitlement to an equitable adjustment for modifications (change orders) made by the government to contract no.
